According to a Opinion of April 16 , Martinelli published a voluntary reminder of a single batch of bottles of a liter of apple juice which were dispatched between March 13, 2023 and September 27, 2023, most of them shipped before July 28 of last year.

The recall was initiated after the state of Maryland tested the apple juice in bottles of one liter, noting that they had levels of inorganic arsenic "above the level of orientation action" issued by Food and Drug Administration of the United States (FDA). Depending on the reminder notice of S. Martinelli & Company, the level was 1.6 parts per billion (PPB) higher than the level of action, which is set at 10 PPB to comply with water requirements.

In the Exit from June 2023 Announcing the new advice for the inorganic arsenic in apple juice, the FDA said that this decision was aimed at "reducing exposure to environmental contaminants of foods commonly consumed by babies and young children".

Although arsenic can be present in food because it is in the environment where they are cultivated, high or treated, it is also associated with negative health effects, said FDA. These include cancer, diabetes, unfavorable birth results and cardiovascular and neurodevelopmental effects.
